1. Introduction

Welcome to the Astromaniac Discord Bot Terms of Service ("Terms"). These Terms govern your use of the Astromaniac's Discord Bots ("Bot") and any services provided by the Bot. By using the Bot, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use the Bot.

2. Acceptance of Terms

By accessing or using the Bot, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as any applicable laws and regulations. If you are using the Bot on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Changes to Terms

Astromaniac reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting the revised Terms on the Astromaniac website. Your continued use of the Bot after the posting of the revised Terms constitutes your acceptance of the changes.

4. Use of the Bot

4.1 Eligibility

You must be at least 13 years old to use the Bot. If you are under 18, you must have the consent of a parent or guardian to use the Bot.

4.2 User Conduct

You agree to use the Bot in accordance with all applicable laws and regulations. You also agree not to:

- Use the Bot for any unlawful purpose or to promote any illegal activities.

- Harass, threaten, or defame any other user or third party.

- Upload or distribute any content that is unlawful, defamatory, obscene, or otherwise objectionable.

- Use the Bot to spam, distribute malware, or engage in any other malicious activity.

- Attempt to gain unauthorized access to the Bot or its underlying systems.

5. Content

5.1 User-Generated Content

You are solely responsible for any content you submit or distribute through the Bot. Astromaniac does not endorse or assume any responsibility for any user-generated content.

5.2 Content Removal

Astromaniac reserves the right to remove or disable access to any content that violates these Terms or is otherwise objectionable, without prior notice and at its sole discretion.

6. Privacy

Your use of the Bot is subject to the Astromaniac Privacy Policy, which is available on the Astromaniac website. By using the Bot, you consent to the collection and use of your information as described in the Privacy Policy.

7. Intellectual Property

All intellectual property rights in and to the Bot, including but not limited to software, text, images, and trademarks, are owned by Astromaniac or its licensors. You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Bot for its intended purpose.

8. Disclaimers

The Bot is provided on an "as is" and "as available" basis. Astromaniac makes no warranties, express or implied, regarding the Bot, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. Astromaniac does not warrant that the Bot will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the fullest extent permitted by law, Astromaniac shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

- Your use or inability to use the Bot.

- Any unauthorized access to or use of the Bot.

- Any content obtained from the Bot.

- Any conduct or content of any third party on the Bot.

10. Indemnification

You agree to indemnify, defend, and hold harmless Astromaniac and its affiliates, officers, agents, and employees from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your use of the Bot or violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Astromaniac operates, without regard to its conflict of law principles.

12. Dispute Resolution

Any disputes arising out of or relating to these Terms or the use of the Bot shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the jurisdiction in which Astromaniac operates.

13. Miscellaneous

13.1 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13.2 Entire Agreement

These Terms constitute the entire agreement between you and Astromaniac regarding the use of the Bot and supersede any prior agreements or understandings, whether written or oral.

13.3 Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
